Last Updated September 2, 2026
NXT Construction Technologies, LLC, together with its parents, subsidiaries and affiliates (the “Company”, “we”, “us” or “our”), is committed to protecting your (“you”, “your”, or “user”) privacy and empowering you with this privacy policy (this “Privacy Policy”). This Privacy Policy explains how we collect, use, disclose, and apply the information collected when you use or access any NXT Construction Technologies product, platform, or website, including, without limitation, the GrndCtrl platform, the NSPEC platform, the SuperClear AI platform, and our public websites, together with any associated services, features, functionality, or content (collectively, the “Platform”). One Privacy Policy applies across all of our products. Please note that if you are a customer of ours, then the Master Subscription Agreement (the “Agreement”) is expressly incorporated herein by reference and is an integral part hereof.
This Privacy Policy sets forth our policy with respect to information that we collect from you, on or through the Platform, that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you (“Personal Data” or “Personal Information”). We take the privacy of your Personal Data seriously. Because of that, we have created and abide by this Privacy Policy. This Privacy Policy is presented to you for acceptance by click at your first login to any of our products. By clicking to accept, by using the Platform, or by interacting with us, you are agreeing to the application of this Privacy Policy. Please read the following carefully to understand how we collect, use, disclose, and maintain information that can be used to identify you. In addition, this Privacy Policy describes your choices for use, access, and correction of your Personal Data. If you do not agree to be bound by this Privacy Policy, please stop accessing or using the Platform.
Google API Services User Data — Limited Use
Some features of the Platform — such as the GrndCtrl Google Sheets integration — let you connect a Google account so the Platform can read data you explicitly authorize. NXT Construction Technologies’ use and transfer to any other app of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.
When you connect a Google account, we request read-only access, and only to the data you authorize:
- Google Sheets data (
spreadsheets.readonly) — the cell values of the specific spreadsheets and tabs you select, so those rows can be displayed and combined with your other business data within your workspace. We never create, modify, or delete spreadsheet content.
Specifically, with respect to data obtained through Google APIs:
- We use it solely to provide and improve the user-facing features you request;
- We do not use it for serving advertisements;
- We do not sell it, and do not transfer it to third parties except as necessary to provide or improve those user-facing features, to comply with applicable law, or as part of a merger or acquisition;
- We do not allow humans to read it, unless (a) we have your affirmative consent, (b) it is necessary for security purposes or to comply with applicable law, or (c) the data is aggregated and anonymized.
Precedence for Google user data. Notwithstanding any other provision of this Privacy Policy — including the sections on Anonymized Personal Data (Section 3.4), the sharing or sale of Anonymized Data (Section 4.6), marketing communications (Section 3.1), and cookies and advertising technologies (Section 2.3.4) — information we receive from Google APIs is governed solely by this section and the Google API Services User Data Policy, including its Limited Use requirements. Such Google user data is: (a) used only to provide and improve the user-facing features for which you granted access; (b) never used to develop, train, or improve any artificial intelligence or machine-learning model, whether generalized or otherwise; (c) never sold, licensed, or transferred to data brokers or information resellers, and never used for advertising — and these prohibitions apply even to anonymized, aggregated, or de-identified forms of the data; (d) not transferred to others except as necessary to provide or improve those user-facing features, to comply with applicable law, or as part of a merger or acquisition in which the successor honors these commitments; and (e) not read by humans except with your affirmative consent, for security or legal compliance, or when aggregated or anonymized for those limited operations.
You can revoke the Platform’s access to your Google data at any time by disconnecting the integration within the Platform, or via your Google Account permissions at myaccount.google.com/permissions.
1. Changes to this Privacy Policy
We may change this Privacy Policy, at any time and from time to time. In the event that we make changes, we will notify you by revising the “Last Updated” date at the top of this Privacy Policy. We encourage you to review our Privacy Policy whenever you access or use the Platform to stay informed of ways that you can protect your privacy.

We and our service providers and business partners use Cookies to collect data and recognize you and your device(s) on the Platform and elsewhere across your different devices.
2.4 Photographs and Location Information
Photographs uploaded to the Platform, including job-site photography submitted through the SuperClear AI platform or the NSPEC platform, may contain embedded metadata recorded by the device that captured them, such as the date, time, and GPS coordinates of the location where the photograph was taken. We collect and store this metadata with the photograph and may use it to provide Platform features, such as associating photographs with the correct project or job site and organizing inspection and defect-detection records. If you do not want location metadata included in your photographs, you can disable location tagging in your device’s camera settings before taking them.
2.5 No Sensitive Data
You agree to not upload, transmit, store, disclose or make available through the Platform any Sensitive Data, and agree and acknowledge that we will have no liability whatsoever for such Sensitive Data erroneously transmitted through the Platform. For the purposes of this Privacy Policy, “Sensitive Data” means any Personal Data that requires a heightened degree of protection by applicable law. Sensitive Data includes, but is not limited to, social security numbers or other government-issued identification numbers, financial account numbers, credit card or debit card numbers, CVVs, credit report information or other personal financial information, health or medical information, or other information that is subject to international, federal, state, or local laws or ordinances now or hereafter enacted requiring heightened standards for data protection or privacy, including, but not limited to, the Health Insurance Portability and Accountability Act, the Health Information Technology for Economic and Clinical Health Act, the Fair Credit Reporting Act, the Children’s Online Privacy Protection Act, and the Gramm-Leach-Bliley Act.
3. How We Use Your Information

These purposes include circumstances where it is necessary to provide or fulfill the services requested by or for you or where you have given us your express consent. 3.3 Other Purposes
If we intend to use any Personal Data in any manner that is not consistent with this Privacy Policy, you will be informed of such anticipated use prior to, or at the time that, the Personal Data is collected, or we will obtain your consent subsequent to such collection but prior to such use.
3.4 Product Improvement and Model Training
We do not sell personal or customer data. We may use the content you and your organization submit to the Platform, together with data about how the Platform is used, to operate, secure, and improve the specific product that the content and data come from. This includes training or fine-tuning the models that deliver that product’s features: for example, the photo defect-detection models behind the SuperClear AI platform; chat routing and response quality in the GrndCtrl platform; and photo captions, observations, and action items in the NSPEC platform. Where reasonably practicable, we de-identify or aggregate content and usage data before using it for improvement or training. Data from one product is used to operate, secure, and improve that product. Organizational customers may elect a Service Improvement Opt-Out on their Order Form; if a customer does so, we will not use that customer’s content to improve the product or to train or fine-tune models, except as necessary to provide the services to that customer. Notwithstanding the foregoing, this Section 3.4 does not apply to information received from Google APIs, which is never used for product improvement or to develop, train, or improve any artificial intelligence or machine-learning model, and which is used and protected exclusively as described in the “Google API Services User Data — Limited Use” section above.
4. How We Share and Disclose Information
4.1 We Do Not Sell Personal Information
We do not sell personal or customer data. We do not otherwise disclose Personal Data we collect about you, except as described herein or otherwise disclosed to you at the time the data is collected. We share information to perform activities that you request.
4.2 Service Providers and Business Partners
To assist us in meeting business operations needs and to perform certain services and functions, we may share Personal Data with various service providers and business providers, including providers of website and/or platform hosting, website and platform-related consulting and monitoring, data analysis, information technology and related infrastructure provision, e-mail delivery, auditing, and other services related to delivering the Platform. Pursuant to our instructions, these parties will access, process, or store Personal Data in the course of performing their duties to us. We take commercially reasonable steps to ensure our service providers adhere to the security standards we apply to your Personal Data.
4.3 Sharing Which You Control
We may ask for your consent to share your Personal Data, and if you agree, we will share your Personal Data accordingly.
4.4 Settings
We may share information consistent with your settings selections within the Platform.
4.5 Other Applications
You may, from time to time, have the ability connect your account with third-party services. By doing so, you’re enabling us and those third parties to exchange Personal Data about you so that we and those third parties can provide, improve, protect, and promote such services. Please remember that third parties’ use of your Personal Data will be governed by their own privacy policies and terms of service.
4.6 De-identified and Aggregated Data
From time to time, we may share or disclose data that has been de-identified or aggregated so that it is not reasonably capable of being associated with or linked to you, your organization, or any other identifiable individual person or entity, for the purposes set forth in Section 3.4 and for other lawful purposes such as reporting and analytics. We do not sell de-identified or aggregated data. This Section 4.6 does not apply to information received from Google APIs, which is never sold, licensed, or shared even in anonymized or aggregated form, as described in the “Google API Services User Data — Limited Use” section above.
4.7 Legal Reasons
We may also disclose your Personal Data when we, in good faith, believe disclosure is appropriate to comply with the law, a court order, or a subpoena. We may also disclose your Personal Data to prevent or investigate a possible crime, such as fraud or identity theft; to protect the security of our Platform; to enforce or apply our policies or other agreements; or to protect our own rights or property or the rights, property or safety of our users or others. We will attempt to notify our users about legal demands for their Personal Data when appropriate in our judgment unless prohibited by law or court order or when the request is an emergency. We may dispute such demands when we believe, in our discretion, that the requests are overbroad, vague, or lack proper authority.
4.8 Sale, Merger, or Other Business Transfer
As we continue to develop our business, we may buy, merge, or partner with other companies. In such transactions (including in contemplation of such transactions), Personal Data may be among the transferred assets. If a portion or all of our assets are sold or transferred to a third-party, your Personal Data would likely be one of the transferred business assets. If such transfer is subject to additional mandatory restrictions under applicable law, we will comply with such restrictions.

Please note that despite any indicated e-mail marketing preferences, we may continue to send you administrative e-mails, including, for example, notices of updates to this Privacy Policy, if we choose to provide such notices to you in this manner.
- In certain circumstances providing Personal Data is optional. However, if you choose not to provide Personal Data that is needed to use some features of our Platform, then you may be unable to use those features.
- Some browsers offer a “do not track” (“DNT”) option. Since no common industry or legal standard for DNT has been adopted by industry groups, technology companies, or regulators, we do not respond to DNT signals. We will make reasonable efforts to continue to monitor developments around DNT browser technology and the implementation of a standard.
